Adoption of Article 140 and 141 of the Law on Special Land Use Conditions No XIII-2166

The Seimas adopted the Law Amending Articles 140 and 141 of the Law on Special Land Use Conditions No XIII-2166 (hereinafter – the Law), which extended the possibility of identifying territories subject to special land use conditions under preferential conditions until 31 December 2024.
It must be noted that after 31 December 2024, the territories indicated in Article 141(3) of the Law may be determined only after obtaining the consent of the land owner, state or municipal land trustee regarding the determination of these territories, i.e., without obtaining the above-mentioned consents, a situation may arise when persons engaged in economic and/or other activities will no longer be able to identify and register the territories specified in the Law and, in accordance with the provisions of the Law, will not be able to conduct activities in those territories from 1 January 2025. As a result, taking into account the consequences that may arise from being unable to identify and register protection zones in the Real Property Register, it is advisable not to delay the implementation of the Law.
